US Tax Court Rules Gender Reassignment Surgery is Deductible Under Tax Code Share

On February 2, 2010, the U.S. Tax Court issued an important decision in O’Donnabhain v. Commissioner of Internal Revenue, ruling for the first time that treatment for gender identity disorder qualifies as medical care under the Internal Revenue Code, and therefore costs related to that care are deductible from federal income taxes.

 

“This is a significant ruling for the transgender community,” said Meghan Stabler, HRC Board of Director and transgender advocate. “The process of sex reassignment effectively treats a widely recognized medical condition, improving health and life outcomes. But transgender men and women alike primarily pay for treatment out of pocket due to discrimination in most health insurance plans. Being able to deduct these expenses, just as with any other medical need, sends a clear message that all transgender people – as well as employers with inclusive health insurance plans – can expect dignity, fairness and equal treatment from the IRS.”

WASHINGTON, D.C. – Today Servicemembers Legal Defense Network (SLDN) launched a national campaign to draw attention to the opportunity President Obama has before him now to uphold his campaign promise to end “Don’t Ask, Don’t Tell.” SLDN is pushing for the President to repeal the archaic 1993 law in his annual defense budget currently being drafted.

Lambda Legal Releases Health Care Discrimination Survey Results; More Than Half of LGBT and HIV Positive Respondents Report Discrimination

New York, NY- Today, Lambda Legal released the first nationwide survey that examines health care discrimination experienced by LGBT people and people living with HIV.

 

"The results of this survey should shock the conscience of this nation and make clear that the system is broken when it comes to health care for many lesbian, gay, bisexual, and transgender people and those living with HIV," said Beverly Tillery, Director of Community Education and Advocacy and one of the authors of the report. "No one should be turned away or face discrimination when they are sick or seeking medical care."

Equality California Sponsors Bill Strengthening Religious Freedoms for Clergy

New bill, introduced by Senator Mark Leno, affirms that no clergy member will be forced under law to perform any civil marriage that is against his or her belief system

 

SACRAMENTO – Equality California announced it is sponsoring new legislation that protects clergy from performing any civil marriage that is contrary to the tenets of his or her faith and that provides clear distinctions between civil and religious marriage in state law. The Civil Marriage Religious Freedom Act, SB 906, introduced by Senator Mark Leno (D-San Francisco) and co-sponsored by California Council of Churches IMPACT, includes in state law that clergy are able to choose which civil marriages they solemnize.
